Delayed submission submits more than specified job count

I have been using the newest version of gauss09 to submit a large number of jobs. I have set the max number of active jobs to 4950, below my limit of 5000. I have been using the following line to check the number of active jobs in the terminal.

squeue --me -h -t pending,running -r | wc -l

When I am at my specified limit, the number of jobs will keep going up for a bit, then it will stop. For example, I have seen 4955, 4988, 4967, etc., all above my specified limit.

This is a problem for me, as 4988 is getting dangerously close to my 5000 item limit, and I won't notice if it goes over and misses submissions. I would expect to never see a number over the specified limit.
