After some hacking around, I found this solution, which I don't know if it has any side effects but seems to work for me:

diff --git a/autoload/pandoc/folding.vim b/autoload/pandoc/folding.vim
index c00627d..ccfba5f 100644
--- a/autoload/pandoc/folding.vim
+++ b/autoload/pandoc/folding.vim
@@ -120,7 +120,7 @@ endfunction
 function! pandoc#folding#MarkdownLevelSA()
     let vline = getline(v:lnum)
     let vline1 = getline(v:lnum + 1)
-    if vline =~ '^#\{1,6}'
+    if vline =~ '^#\{1,6}[^.]'
         if synIDattr(synID(v:lnum, 1, 1), "name") !~? '\(pandocDelimitedCodeBlock\|clojure\|comment\)'
            if g:pandoc#folding#mode == 'relative'
                return ">". len(markdown#headers#CurrentHeaderAncestors(v:lnum))

Hope this helps!

The same is valid for the :TOC functionality. Any list with the #. format will appear as a level 1 item.
