This is intended behavior as the war template is not a fully functional exploded web application. Instead it's the base for development tasks (e.g. dev mode) and Eclipse to run from. So bassically it should be a copy of src/main/webapp + libs in WEB-INF/lib + classes in WEB-INF/classes.
Yes it's a bug that the contents of 'build/out' are copied to the war template. These contents aren't necessary but it was the easiest solution to "recycle" the copy spec of the "war" task. I'll leave this issue open to find a cleaner solution for this.

If you want to have a fully functional exploded version of the draft war use something like this:

task explodedDraftWar {
    with tasks.draftWar
    dependsOn tasks.draftWar.dependsOn
    into file('PUT FOLDER IN HERE')
}
