Sorry for the late reply. :P Unfortunately the requirements are a little vague (since many sites just notify the user about the use of cookies), so it may or may not be enough. Perhaps adding a message to the bottom of the screen (not the footer, the message would have to be fixed and easily visible) would do the trick. That way we would be notifying the user, but we wouldn't have to worry about checking if we're allowed to set cookies.
