new Error offered little apart from stack which is non-standard and therefore did not justify the added bytes in a minimalist library. Code that does not sanitise the arguments to Big methods could always catch these simple error messages and throw Error objects itself where required.
Looking again, I think you are right that it would be better to be throwing Error objects, particularly for node.
You've also got me thinking that I really should be including the stack in the bignumber.js error objects.
