The is generated and that seems to be what the validators don't like. Leave them out and all seems okay. It puzzles me though as a terminating tag is optional as you said so it should validate. If you look at http://www.w3.org/TR/html4/struct/lists.html you'll see that nested lists are deprecated. So something else is needed, but quite what one is supposed to use instead I don't know. The validators don't seem like the terminating tag for nested list items.
What would you recommend/want for the alt text on the title image?
Add a commandline option for it (and an edit box in the GUI). Perhaps use a default based on the main title name if it is not specified.

No, just the example is deprecated, but nowhere does it state that
nested lists themselves are deprecated. The wording in the example
definitely needs to be updated, perhaps they are referring to the
missing ?
I'm not keen on adding another command-line option, especially when
you can provide your own HTML title file instead of an image for
more complex stuff. My own thought was to use the document title,
so we'll go with that...
