There's no simple workaround aside from implementing no_args. The following code works:

require "spectator"

class NoArguments < Spectator::Mocks::Arguments
  def args
    [] of Symbol
  end

  def opts
    NamedTuple.new
  end

  def ===(other) : Bool
    other.args.empty? && other.opts.empty?
  end
end

def no_args
  NoArguments.new
end

Spectator.describe "GitHub issue #28" do
  class Foo
    def foo
      bar
    end

    def bar
      42
    end
  end

  mock Foo do
    stub bar
  end

  describe Foo do
    it "works" do
      expect(subject).to receive(:bar).with(no_args).and_return(42)
      subject.foo
    end
  end
end

I'll see about getting this in shortly.

Should be possible in v0.9.39 - Can you try it and verify?
